Saturday night and raining. Abed Sabbagh tapped his fingers on the dashboard of our taxi, gently strumming along to the oud streaming from Bethlehem\u2019s 89.6FM. I watched as the procession of yellow license plates approached Mazmuriyeh checkpoint, some passing without inspection, others stalled by a throng of Israeli soldiers.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abed is a Palestinian from the Sheikh Jarrah neighborhood of East Jerusalem. As a lifelong resident of Sheikh Jarrah, Abed has a blue Jerusalem ID card and drives a taxi with Israel\u2019s authorized yellow plates. Both forms of documentation allow him to pass through the \u2018Israeli-only checkpoints\u2019 that separate Jerusalem from the Occupied West Bank.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abed\u2019s favorable documentation made him a welcome ally on my journey back to Ben Gurion International Airport. I had squandered my last few hours exploring Bethlehem\u2019s Christmas markets, and the surcharge for Abed\u2019s \u2018Israeli-plates\u2019 seemed like a small price to pay if I could avoid the crowds at <\/span><a href=\"https:\/\/www.washingtonpost.com\/graphics\/world\/occupied\/checkpoint\/?utm_term=.9dde999c29db\"><span style=\"font-weight: 400;\">Checkpoint 300<\/span><\/a><span style=\"font-weight: 400;\">, where <\/span><a href=\"https:\/\/interactive.aljazeera.com\/aje\/2018\/commuting-through-israeli-checkpoints\/index.html\"><span style=\"font-weight: 400;\">15,000 Palestinians cross each day<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I leaned forward to adjust the heat. \u201cHow long have you been driving a taxi?\u201d I asked, shifting again to locate my passport.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cSince October,\u201d said Abed, popping open the dashboard to grab his ID. \u201cI used to work for USAID, but Trump cut our funding and everyone was laid off.\u201d I glanced down at the passport in my hand and blushed. The past two years have seen a costly reorientation of American foreign policy towards Palestine. Where Secretary of State John Kerry tried to pursue a centrist agenda and revive Israeli-Palestinian peace talks, political appointee Jared Kushner and Secretary of State Michael Pompeo have placed American policy in lock-step with Netanyahu\u2019s conservative Likud party. Specific policy decisions &#8212; like <\/span><a href=\"https:\/\/www.brookings.edu\/blog\/order-from-chaos\/2018\/09\/07\/in-one-move-trump-eliminated-us-funding-for-unrwa-and-the-us-role-as-mideast-peacemaker\/\"><span style=\"font-weight: 400;\">the suspension of all US contributions to UNRWA<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.haaretz.com\/us-news\/u-s-ends-aid-to-west-bank-gaza-at-palestinian-authority-s-request-1.6897612\"><span style=\"font-weight: 400;\">the termination of USAID funding to Palestine<\/span><\/a><span style=\"font-weight: 400;\">&#8212; have reversed decades of American foreign policy decisions within the region and imperiled the lives of Palestinians on the ground.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cID CARDS, PLEASE,\u201d a curt voice interjected.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abed passed our documentation to a somnolent soldier, and then turned back to me: \u201cI\u2019ll tell you something, society is moving more and more to the right. The media, the government: everything is going exactly where Israel wants.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I lifted the corners of my smile as the soldier matched my passport to my face. As he glanced up and down with a bit more interest, everything inside me turned a sickly, saccharine sweet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Israeli Authorities delivered my family a final eviction notice on January 3rd,\u201d Abed said quietly, as we drove away. If evicted, <\/span><a href=\"https:\/\/mondoweiss.net\/2019\/05\/demolitions-jerusalem-officials\/\"><span style=\"font-weight: 400;\">Abed will join another 193 Palestinians who have been displaced from their homes in East Jerusalem since January<\/span><\/a><span style=\"font-weight: 400;\">&#8212; a rate of displacement that outpaces anything documented over the past thirty years. \u201cMy children ask why we are packing, and what I can tell them? Wednesday will come, and then where we will go\u2026?\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">* * *\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abed\u2019s father Mohammad Sabbagh was born in 1948, just months after the United Nations adopted the Partition Plan for Palestine. His family is from<\/span> <a href=\"https:\/\/www.palestineremembered.com\/al-Ramla\/Yibna\/index.html\"><span style=\"font-weight: 400;\">Yibna<\/span><\/a><span style=\"font-weight: 400;\">, seven kilometers north of Palestine\u2019s famed port city, Jaffa. His parents owned 60 acres of farmland and grew much of their own food. Citrus grows well along the Mediterranean Coast.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mohammad and his family left the farm before he was old enough to walk. They were expelled by Israeli soldiers on June 4, 1948, just one month after David Ben-Gurion declared the founding of the modern Jewish state.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like many, the Sabbaghs fled to Jerusalem, \u201cAnd I remember every day and every second until now,\u201d Mohammad insisted over the phone. He has lived in the same home in Sheikh Jarrah East Jerusalem since 1956 when <\/span><a href=\"https:\/\/www.adalah.org\/uploads\/oldfiles\/newsletter\/eng\/feb10\/docs\/Sheikh_Jarrah_Report-Final.pdf\"><span style=\"font-weight: 400;\">the United Nations Relief and Works Agency (UNRWA) and the Jordanian government promised property deeds to his father<\/span><\/a><span style=\"font-weight: 400;\"> as part of a joint humanitarian initiative targeting Palestinian refugees. The Sabbaghs were one of 28 select families who received housing under the program, and to this day, \u201cwe know all the families who live here,\u201d said Mohammad.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mohammad hopes that the documentation provided by UNRWA\u2019s 1956 initiative will strengthen his family\u2019s eviction defense: Where most Palestinian families lack titles for their homes, he can point to a legal document endorsed by the international community.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cI am not going to show myself as hopeless,\u201d said Mohammad. \u201cBut everyone who comes to watch what is going on in the Israeli courts knows that [the proceedings] are a joke.\u201d\u00a0<\/span><\/p>\n<p>* * *<\/p>\n<p><span style=\"font-weight: 400;\">Sami Ershaid is the family lawyer. He has worked with the Sabbagh\u2019s since their first eviction notice on July 19, 2009. Sami is a native Jerusalemite and he represents ten of the families in the Kerem Al-jouni area of Sheikh Jarrah, where the majority of eviction notices have been disbursed.\u00a0<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">In all cases, the families are in litigation against Nahalat Shimon International (NSI), <\/span><a href=\"https:\/\/www.adalah.org\/uploads\/oldfiles\/newsletter\/eng\/feb10\/docs\/Sheikh_Jarrah_Report-Final.pdf\"><span style=\"font-weight: 400;\">a shadowy real estate company<\/span><\/a><span style=\"font-weight: 400;\"> who \u201cpurchased\u201d land in Sheikh Jarrah <\/span><a href=\"https:\/\/fmep.org\/resource\/settlement-report-november-21-2018\/#SabagEviction\"><span style=\"font-weight: 400;\">from the Jews who owned it prior to the 1948 war<\/span><\/a><span style=\"font-weight: 400;\">. Since 2003, Nahalat Shimon International has been taking legal action to evict Palestinian residents from their land. If successful, the firm will build <\/span><a href=\"http:\/\/d3n8a8pro7vhmx.cloudfront.net\/globalministries\/legacy_url\/12409\/Microsoft-Word-Evictions-and-Settlement-Plans-in-Sheikh-Jarrah.pdf?1419975211\"><span style=\"font-weight: 400;\">a 200-unit settlement<\/span><\/a><span style=\"font-weight: 400;\"> called Shimon HaTzadik in reference to the Second Temple high priest that they believe is buried there.<\/span><\/p>\n<div id=\"attachment_375\" style=\"width: 236px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-375\" class=\"size-medium wp-image-375\" src=\"http:\/\/thanassiscambanis.com\/sipa\/wp-content\/uploads\/2019\/10\/Picture1-6-226x300.png\" alt=\"The Sabbaugh\u2019s January 3, 2019 Eviction Orders\" width=\"226\" height=\"300\" srcset=\"http:\/\/thanassiscambanis.com\/sipa\/wp-content\/uploads\/2019\/10\/Picture1-6-226x300.png 226w, http:\/\/thanassiscambanis.com\/sipa\/wp-content\/uploads\/2019\/10\/Picture1-6.png 518w\" sizes=\"auto, (max-width: 226px) 100vw, 226px\" \/><p id=\"caption-attachment-375\" class=\"wp-caption-text\">The Sabbaugh\u2019s January 3, 2019 Eviction Orders<\/p><\/div>\n<p><i><\/i><span style=\"font-weight: 400;\">Evictions in East Jerusalem follow a predictable legal path. Most often, an Israeli citizen or development company files a complaint that property residents have violated the law, usually by expanding their home without an Israeli-issued building permit. The Jerusalem Municipality will then investigate the claim and if the allegations are confirmed, the municipality can evict the Palestinian residents or even demolish their home. On paper, the Jerusalem Municipality is simply enforcing zoning and building codes. But in practice, the penalties disproportionately affect Palestinian residents, <\/span><a href=\"https:\/\/www.haaretz.com\/israel-news\/.premium-only-7-of-jlem-building-permits-go-to-palestinian-neighborhoods-1.5432437\"><span style=\"font-weight: 400;\">who receive only 7% of the annual building permits issued in Jerusalem<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sabbaghs have been charged with both unpermitted construction and rent delinquency. In Sami\u2019s opinion, the first charge is hard to avoid: In the five years prior to the Sabbagh\u2019s initial eviction notice in 2009, only <\/span><a href=\"http:\/\/bimkom.org\/eng\/wp-content\/uploads\/TrappedbyPlanning.pdf\"><span style=\"font-weight: 400;\">130 Palestinian families in East Jerusalem received construction permits each year<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> This discriminatory policy has prevented Palestinian families like the Sabbaghs from accommodating generational growth, forcing families to make an impossible choice: they can separate their family and send some away, or expand and renovate in violation of Israeli law. Given this reality, many families elect to build additional housing units without permissio<\/span><span style=\"font-weight: 400;\">n.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sabbagh\u2019s have an additional incentive to maintain their Sheikh Jarrah address: as residents of Jerusalem, their Jerusalem blue ID cards afford the entire family access to national healthcare and insurance benefits, as well as the right to move freely between Jerusalem and the West Bank. These marginal gains help both Abed and Mohammad overlook the discrepancies in public services offered in Jewish West Jerusalem and Arab East Jerusalem, where <\/span><a href=\"https:\/\/www.btselem.org\/jerusalem\"><span style=\"font-weight: 400;\">only 52% of the population has access to tap water<\/span><\/a><span style=\"font-weight: 400;\"> and 76% of residents live below the poverty line. The company attorney cites the <\/span><a href=\"https:\/\/www.adalah.org\/uploads\/oldfiles\/newsletter\/eng\/feb10\/docs\/Sheikh_Jarrah_Report-Final.pdf\"><span style=\"font-weight: 400;\">1982 Toussia-Cohen Agreement<\/span><\/a><span style=\"font-weight: 400;\">, in which two settler groups filed a joint civil suit against 23 Palestinian families in Sheikh Jarrah. During the proceedings, Israeli attorney Yitzhak Toussia-Cohen <\/span><a href=\"https:\/\/www.adalah.org\/uploads\/oldfiles\/newsletter\/eng\/feb10\/docs\/Sheikh_Jarrah_Report-Final.pdf\"><span style=\"font-weight: 400;\">did not challenge the validity of the settlers\u2019 pre-1948 ownership claims<\/span><\/a><span style=\"font-weight: 400;\"> and instead accepted the status of \u2018protected tenants\u2019 for all 17 of his Palestinian clients. This small clerical adjustment has allowed settler groups to claim \u2018rent delinquency\u2019 against their newly designated tenants. The Sabbagh\u2019s friends, the Al-Kurd and Hanoun families, have already been evicted based on legal claims linked to their status as \u2018protected tenants\u2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Luckily for Abed and his family, the Sabbaghs were not one of Toussia-Cohen\u2019s clients. Consequently, their legal status never changed fr<\/span><span style=\"font-weight: 400;\">om \u2018lawful resident\u2019 to \u2018protected<\/span><span style=\"font-weight: 400;\"> tenant\u2019. This rare fact \u2014coupled with their 1956 UNRWA documentation\u2014should safeguard the Sabbaghs against legal claims linked to rent delinquency.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cTheir next court date will come on September 5th, 2019,\u201d Sami tells me. When the hearings resume, the <\/span><span style=\"font-weight: 400;\">Sabbagh<\/span><span style=\"font-weight: 400;\">s will be the first non-signatory family to have their <\/span><span style=\"font-weight: 400;\">ownership status challenged since <\/span><a href=\"https:\/\/www.adalah.org\/uploads\/oldfiles\/newsletter\/eng\/feb10\/docs\/Sheikh_Jarrah_Report-Final.pdf\"><span style=\"font-weight: 400;\">an unsuccessful attempt to evict four non-signatory households in 1974<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> If evicted, the Sabbagh\u2019s removal will signal a new chapter in Israel\u2019s brazen disregard for United Nations\u2019 documentation and international law. \u201cThe appeal process will be interesting,\u201d said Sami. \u201cBut I have a couple of ideas about what we can do.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">* * *\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sabbagh\u2019s presence in East Jerusalem is cumbersome for the Israelis. Close to the Old City, Sheikh Jarrah is a long-time target of Israeli policymakers who seek to<\/span><a href=\"https:\/\/carnegieendowment.org\/sada\/75006\"> <span style=\"font-weight: 400;\">restore the 70:30 demographic ratio of Jews to Palestinians<\/span><\/a><span style=\"font-weight: 400;\"> that existed within the Jerusalem metropolitan area in 1967. The Israeli Municipality\u2019s \u201cJerusalem Outline Plan 2000\u201d expressly states a goal of \u201cmaintaining a solid Jewish majority in Jerusalem\u201d, in order to \u201c<\/span><a href=\"https:\/\/www.palestine-studies.org\/sites\/default\/files\/jps-articles\/jps.2010.xl_.1.193.pdf\"><span style=\"font-weight: 400;\">to establish the status of Jerusalem as the capital of Israel and the center of the Jewish people<\/span><\/a><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Policies guided by demographic manipulation and territorial expansion date back to Israel\u2019s first political leaders. In 1948, Israeli President Chaim Weizmann cited, \u201c<\/span><a href=\"https:\/\/mfa.gov.il\/MFA\/ForeignPolicy\/MFADocuments\/Yearbook1\/Pages\/3%20Israel%20Claims%20Jerusalem-%20Address%20by%20President%20We.aspx\"><span style=\"font-weight: 400;\">the fact of [Jews] numerical preponderance among [Jerusalem\u2019s] inhabitants as an indication that Jerusalem is and should remain ours<\/span><\/a><span style=\"font-weight: 400;\">,\u201d a sentiment echoed by Prime Minister David Ben Gurion in his 1949 address to the UN General Assembly: \u201cThe peace, security and economic consolidation of Jerusalem [is Israel\u2019s] principal care. For the State of Israel there is, has been and always will be one capital only. The campaign has been building momentum for years: residency revocations, home demolitions, and settlement expansions have long-driven Palestinians out of the city, displacing <\/span><a href=\"https:\/\/www.middleeastmonitor.com\/20190429-israel-forced-3000-palestinians-out-of-their-homes-in-jerusalem-over-15-years-says-btselem\/\"><span style=\"font-weight: 400;\">approximately 3,000 Palestinians from their East Jerusalem homes<\/span><\/a><span style=\"font-weight: 400;\"> between 2004 and 2018<\/span><span style=\"font-weight: 400;\">. Impoverished public works programs have <\/span><a href=\"https:\/\/www.btselem.org\/publications\/summaries\/201902_fake_justice\"><span style=\"font-weight: 400;\">further incentivized Palestinians to relocate<\/span><\/a><span style=\"font-weight: 400;\"> outside of Jerusalem, despite the benefits afforded by a Jerusalem ID.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But 2019 marks a new era. \u201c<\/span><span style=\"font-weight: 400;\">After more than 20 years fighting Israel&#8217;s policy of demolishing Palestinian homes, I am witnessing one of the largest campaigns of demolitions since we started our work,\u201d says Jeff Halper, Director of the Israeli Committee Against House Demolitions (ICAHD). <\/span><span style=\"font-weight: 400;\">Between the months of January and March 2019 alone, 193 Palestinians have lost their homes, often <\/span><a href=\"https:\/\/www.btselem.org\/video\/20190428_self_destruction_jm_municipality_forcing_palestinians_to_demolish_their_own_homes#full\"><span style=\"font-weight: 400;\">electing to \u2018self-demolish\u2019 their homes<\/span><\/a><span style=\"font-weight: 400;\"> in order to avoid thousands of dollars in demolition fees charged by the Jerusalem Municipality. The Israeli rights group B\u2019tselem estimates that another 330,000 Palestinians in East Jerusalem are at risk of losing their homes. <\/span><span style=\"font-weight: 400;\">\u201cI don\u2019t know how to react anymore,\u201d says Jeff. \u201cThe scale of demolition makes protest and resistance impossible.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">* * *\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Abed has decided to focus on the small wins: their delayed eviction, the Friday protests, the support of the international community. \u201cI do not want to be a millionaire,\u201d says Abed. \u201cI just want a simple life, but I don\u2019t want to leave it. I prefer a small apartment here in Sheikh Jarrah than a villa in another beautiful place.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sabbagh family is just another victim of Israeli policies that have spanned seven decades. Some Israeli administrations have been more lenient than others, but the consequences of these policies have been consistent: expansion of Israeli control over Palestinian territory, and discriminatory restrictions on travel, jobs, housing, and services that make life difficult for Palestinians. With strongman President Trump and revanchist Ambassador David Friedman in office, Prime Minister Netanyahu has found welcome allies for his Zionist campaign. Over the past two years, the US administration has buoyed Netanyahu\u2019s rapacious campaign to establish demographic and territorial control across Jerusalem and the West Bank, first, by announcing plans to relocate the US embassy to Jerusalem, and most recently, by <\/span><a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-47697717\"><span style=\"font-weight: 400;\">recognizing Israeli sovereignty over the occupied Golan Heights<\/span><\/a><span style=\"font-weight: 400;\">. Both announcements came as the Trump administration shuttered the PLO mission in Washington, and closed the US consulate in Jerusalem&#8211;which has historically served East Jerusalem\u2019s Palestinian residents&#8211;\u00a0 effectively ending all diplomatic ties with the Palestinian Authority.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Steady displays of international support have emboldened Israeli policymakers to further both their legalistic and territorial control: notably marked by the passage of the<\/span><a href=\"https:\/\/www.vox.com\/world\/2018\/7\/31\/17623978\/israel-jewish-nation-state-law-bill-explained-apartheid-netanyahu-democracy\"><span style=\"font-weight: 400;\"> Nation State Law<\/span><\/a><span style=\"font-weight: 400;\"> in July 2018, and <\/span><a href=\"https:\/\/www.foxbusiness.com\/features\/israeli-settlement-activity-appears-to-surge-in-trump-era\"><span style=\"font-weight: 400;\">a 20 percent increase in new settlement construction<\/span><\/a><span style=\"font-weight: 400;\"> during the first nine months of 2018, as reported by anti-settlement monitoring group Peace Now.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As the 71st anniversary of the Nakba approaches on May 15th, marking <\/span><a href=\"https:\/\/www.aljazeera.com\/indepth\/features\/2017\/05\/nakba-start-1948-170522073908625.html\"><span style=\"font-weight: 400;\">the forced removal of over 700,000 Palestinians<\/span><\/a><span style=\"font-weight: 400;\"> from their ancestral homes, ICAHD Director Jeff Halper fears that the Israelis are just mopping up. \u201cThey\u2019ve displaced the indigenous population from 85% of the country,\u201d he said. \u201cAnd the rest are locked into Areas A and B in the West Bank, or effectively jailed in Gaza.\u201d<\/span><br \/>\n<span style=\"font-weight: 400;\">For Israel\u2019s remaining Palestinian residents, lawyer <\/span><span style=\"font-weight: 400;\">Sami Ershaid<\/span><span style=\"font-weight: 400;\"> warns that their legal protections are all but gone. \u201cFive years ago, I also spoke with American journalists and I used to tell them: If you really want to prevent a home demolition in East Jerusalem, call the American Ambassador: he was the only person who could stop a demolition.
